Family law courts have long struggled with what to do when the parent with whom the children primarily reside decides to move out of state. Although Colorado statues now governs this issue where parents cannot agree, there are still no easy answers to this question.

Parental Relocation and the Law

The law requires that when the relocation of a parent will substantially change the geographical ties between the children and the other parent, the parent seeking to move must:

  • Give notice of the relocation to the other parent  

  • Provide the reason for the move

  • Propose modifications to the existing parenting time schedule

Unless the other parent agrees to the relocation, the court will have to decide the issue. The good news is that such cases are given priority on the court's docket. The court must decide the issue based on the best interest of the children and must balance many competing interests, including the reason for the move, the other party's reason for objection, and the advantages or disadvantages of the proposed move to the children.
