Paternity means fatherhood. A man may admit paternity of a child or be declared the father after a paternity test. In either case, he takes on the financial responsibilities of raising the child, including the obligation of child support, the cost of pregnancy, and childbirth expenses. However, the father of a child is not automatically granted the privilege of visitation and parenting time. These are rights that he must asset if he wants the benefits of participating in the raising of his child.

A Mother's Rights

For mothers, we can take action in court to require the supposed father and the child to undergo paternity testing. If the test determines that he is indeed the father, we can take action to obtain a court order for child support, and if need be, an enforcement order to obtain past and future child support payments. In almost every case, a blood test is no longer used. Rather, saliva samples are taken from the child and the supposed father, and the DNA is compared. Taking the saliva sample is painless and is accomplished in a matter of minutes.

A Father's Rights

For men who believe they are the father of a child and wish to secure the right of parenting time or custody, we can go to court and obtain a paternity test for you and the child. If the test indicates that you are the father, we can take action to affirm and assert your fatherhood rights, including parenting time. However, you must demonstrate to the court that you have a desire to play an active role in raising the child and that parenting time with you or custody is in the best interests of the child.

A Child's Rights

A child has the inheritance rights to the estate of his or her biological father, as well as Social Security benefits. We can represent your child in these matters.
